Terms of Use

These terms cover use of the LaChute Designs website and provide general ground rules for inquiries and design services. A project-specific written agreement or invoice may contain additional terms.

Using this website

By accessing or using lachutedesigns.online, you agree to these Terms of Use. If you do not agree, please do not use the website.

The website is provided to describe LaChute Designs, display selected work, provide general pricing information, and allow prospective clients to make contact. Content may be changed, corrected, or removed at any time.

Quotes, pricing, and project scope

Prices shown on this website are general starting points unless expressly stated otherwise. A project is not accepted and a price is not guaranteed until the scope, deliverables, timing, and payment terms have been confirmed by LaChute Designs.

The current $199 Starter Website is a defined entry-level service and is generally paid in full before work begins. Larger custom projects are generally structured as 50% to begin and 50% before launch unless a written quote or agreement states different terms.

Project-specific proposals, estimates, invoices, emails, or written agreements control if they conflict with general information on this website.

Client responsibilities

Clients are responsible for providing accurate information, timely feedback, and the text, images, logos, trademarks, credentials, and other materials needed to complete the agreed project unless LaChute Designs has agreed to provide them.

  • You represent that you have the right to use and provide all materials you supply.
  • You are responsible for reviewing names, addresses, phone numbers, pricing, dates, spelling, legal statements, and other factual content before final approval.
  • For website projects, clients currently purchase and maintain their own domain name and hosting account unless otherwise agreed in writing.
  • Delays in receiving content, approvals, access credentials, or feedback may delay the project timeline.

Revisions, changes, and third-party costs

Included revisions are limited to the scope described in the applicable package, estimate, or agreement. New pages, new concepts, major direction changes, additional rounds of revisions, or functionality requested after approval may require an additional charge.

Domains, hosting, premium plugins, stock assets, fonts, software subscriptions, ecommerce fees, booking services, payment-processing fees, and other third-party products are not included unless specifically stated. Those services are governed by their own providers and may have separate recurring charges.

Payments, cancellations, and refunds

Payment schedules will be shown in the applicable package, invoice, proposal, or written agreement. Work may be paused or delivery withheld when a required payment is overdue.

If a project is cancelled, amounts already paid are applied to reserved production time, work already performed, and any nonrefundable third-party costs. Any refund eligibility will depend on the stage of the project and the written terms that apply to that project. Contact LaChute Designs promptly if you need to cancel or postpone work.

Ownership and portfolio use

You retain ownership of materials you provide. Unless otherwise agreed in writing, rights to final custom deliverables created specifically for you transfer after full payment, subject to any third-party licenses and any reusable tools, methods, frameworks, templates, code, fonts, stock assets, or other pre-existing materials used to create the work.

LaChute Designs may display completed work, client names, screenshots, photographs, or project descriptions in a portfolio, website, social media, or promotional materials unless confidentiality or another restriction is agreed to in writing before the work is published.

Website and third-party service limitations

Websites depend on hosting companies, browsers, WordPress, themes, plugins, APIs, payment processors, ecommerce platforms, booking systems, and other third-party technology. LaChute Designs cannot guarantee that third-party services will remain available, unchanged, compatible, secure, or free of charge.

Unless specifically included in an ongoing care agreement, future updates, maintenance, security monitoring, content changes, compatibility fixes, software renewals, and third-party service fees are the client’s responsibility after project completion.

No warranties and limitation of liability

The public website and its informational content are provided on an “as is” and “as available” basis. While I make reasonable efforts to provide accurate information and professional work, no specific business result, search ranking, sales result, traffic level, uptime percentage, or revenue outcome is guaranteed.

To the fullest extent permitted by law, LaChute Designs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website or third-party services. Any project-specific liability limitations stated in a written agreement will control for that project.

Acceptable use and intellectual property

You may browse and share links to this website for lawful purposes. You may not copy, republish, sell, scrape, exploit, or misrepresent LaChute Designs content, portfolio work, branding, source code, or other protected materials except as allowed by law or with written permission.

You may not attempt to interfere with the website, gain unauthorized access, distribute malicious code, submit fraudulent inquiries, or use the site in a way that violates applicable law or the rights of others.

Governing law and changes

These website Terms of Use are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These terms may be updated from time to time. Continued use of the website after an update means the revised terms apply to future use of the site. Material project terms already agreed in writing will not be changed merely by updating this page.
